This Service Agreement (the "Agreement") describes the terms and conditions under which kotuha ("we", "our services" or "our company") offer services to users ("User", "You", "Uploader"). By using kotuha services, the User agrees to be bound by the following terms and conditions. We reserve the right to modify this Agreement at any time and without prior notice.
1) Kotuha services
Kotuha allows the User to upload and store specified File to kotuha.com servers and to provide a description for download. The maximum allowed size of File is 64 megabytes. File downloads are limited to 3 downloads in any 10 minute period and 256 megabytes per 60 minutes per IP. There is no limit on total number of files uploaded. Files which are not dowonloaded at least once within 7 days after upload will be removed. Otherwise, the file availability depends on the settings made by uploader after the file is uploaded.
Our services are provided "as is" and we make no warranties about the accuracy, reliability, completeness, or timeliness of our services, software, or content. We are in no way responsible for the content uploaded by users of kotuha. Any material downloaded or otherwise obtained through the use of the kotuha website is accepted by you at your own risk and you are solely responsible for any damage to your computer system or loss of data that results from the download of files or any use.
If you think a file should be removed please let us know by reporting the file as abusive and we will review it as soon as possible. If your complaint is justified we will delete the file as soon as possible! We reserve the right to remove any files at any time without giving a prior notice or stating the reason.
2) Privacy policy
We routinely gather information about your access to, and usage of, kotuha services. While we strongly respect your privacy, we may disclose information about you if we are required to do so by law or we in good faith believe that such action is necessary (a) to comply with the law or with legal process; (b) to protect and defend our rights and property; (c) to protect against misuse or unauthorized use of our website; (d) to protect the personal safety or property of our users or the public (among other things, this means that if you provide false information or attempt to pose as someone else, information about you may be disclosed as part of any investigation into your actions).
In the course of serving advertisements to this site, our third-party advertiser may place on, or read cookies from, your browser.
3) Copyright policy
Our services may be used only for lawful purposes. Distribution or storage of any material in violation of any applicable laws or regulations, including export control laws, is prohibited. This includes, without limitation, material protected by patent, copyright, trademark, service mark, trade secret or any other intellectual property rights. If you use another party's material, you must obtain prior authorization. By using the kotuha, you represent and warrant that you are the author and copyright owner and/or proper licensee with respect to any hosted content and you further represent and warrant that no content violates the trademark or rights of any third party. We reserve the right to suspend or remove any files that violate these policies or any law or regulation.
